I am writing you so that you know you are in violation of an FTC law called COPPA as well as copyright infringement. Regardless of you obfuscate the picture, you are in violation in several ways.
You do not have verifiable parental permission nor copyrights of the picture of my daughter. Facebook maintains my copyright and holds a license to it that only applies to Facebook related sites until that picture is deleted. (see facebook copyright policy)
Feel free to contact me for settlement or any of the entities that will be in contact with you in the days to come.

Wow, I have to thank my friend Justin for contacting me to ask me if I'm actually behind this blog. Why would I be, I commented to him, since I was featured here not once but twice early on.
ReplyDeleteNeedless to say, I was really amazed to see my name here in print and full accusation. I'd like to assure you, guys, that I don't have the time nor the interest to do something as hateful as this that causes people I don't even know unnecessary pain and public humiliation. I have enough of my own pain to deal with and enough of my own personal happiness to pursue.
Sorry you're all having to deal with this. Unfortunatelt, the real masterminds behind Beardrama continue to wring their hands and giggle to themselves.

But, why would I make such a passionate effort at chronicling information in order to embarrass people when I made a huge stink about the same kind of behavior on the Livejournal community, "Badbearprofiles", the drama about which is featured in one of the very first articles on this blog?

COPPA applies to "If you operate a commercial Web site or an online service directed to children under 13 that collects personal information from children or if you operate a general audience Web site and have actual knowledge that you are collecting personal information from children."
ReplyDeleteClearly this info was not obtained from a child. Following your logic there could be NO pictures of children anywhere on the web without their parents permission. If you took pictures at a Renassiance Fair (something I'm sure all of you attend every year) and there was a child in the pic, you couldn't post it online??? See how silly that sounds?
Whether or not this is a Facebook copyright violation, well good luck with that one. There are plenty of websites (Failbook, etc) that exist just to report and mock Facebook postings.
Having said that I do think this blog was unwise to post the actual Facebook profile names, no matter how ridiculous they appeared.
The bottom line is that if the original couple had not posted their crazy sh*t on Facebook, we would not be having these discusssuions.

Besides COPPA, there are other laws, COPA, state laws, other FTC laws that have a similar basis which could apply here since this *is* a website that is adult in nature with an adult warning.
ReplyDeleteWhoever posted that picture was stupid in the extreme and should be taken out and ceremoniously shot. As soon as the admins of this site have been identified and located, a warrant officer will deliver the subpoena and this will go to hearing. Attorney at LOL might think no one can be sued but the truth is, anyone can be sued once identified.
It's a true coward who strikes someone behind anonymity. They should probably consider leaving the country or offering apology before this gets out of hand. The question is not if but when this person will be identified.
While most people here sleep easy after reading a lol, a parent with one child whose child has been attacked will not rest until the site goes down or the guilty party comes forward. He's already been persuaded from pursuing the admins by taking the law into his own hands and is working with law enforcement as I write this. Furthermore, he is under watch. You dolts don't realize that you are fucking with people's lives at times and that some people can take a joke more easily than others. I just know that if it were just limited to himself, he would have taken this in stride but because this involves his own daughter, this is something he takes much more seriously.
The Reading Police Department, FBI internet crime division has a case number on this already and copyright attorneys were contacted but that's all I know. That's all the information that I or himself will offer at this time. I wouldn't be surprised if this site went down tomorrow but blogspot is very slow to respond. I do know that the Report Abuse option has been applied here and if they get enough reports from unique addresses, this site will go down. Seen it before so just telling people here in advance what we're looking at in the week to come. Yes, happy holidays indeed.
